NY Retail Worker Safety Act Plan — Labor Law §27-e
Required of every NY retail employer with 10+ retail employees. Effective March 4, 2025. Includes the workplace violence prevention policy, annual training program, and the panic button system framework (500+ employee retailers, January 2027 deadline).

Signed September 2024 (S8358B/A8947C); effective March 4, 2025 (panic button by January 1, 2027). Many NY retailers have not yet developed compliant policies. The plan addresses the new mandate at the depth and specificity §27-e requires.
10-employee threshold (per retailer)
Applies to any NY retailer with 10 or more retail employees company-wide. Threshold counts retail employees across all NY locations of the same employer. Smaller retailers (under 10) are exempt. The plan documents the threshold determination.
Panic button system framework
Retailers with 500+ retail employees company-wide must implement a panic button (silent alert) system by January 1, 2027. The system must let employees discreetly summon assistance during a workplace violence incident. The plan includes the framework — alert delivery to designated responders, location identification, employee training, periodic testing.
Five required training topics
§27-e specifies five required annual training topics: (1) WV definition and types; (2) Identifying warning signs of violence; (3) De-escalation; (4) Active shooter / emergency procedures; (5) Reporting and post-incident procedures. The training outline meets all five.

Who must comply with the Retail Worker Safety Act?
NY retail employers with 10 or more retail employees company-wide. 'Retail employee' means an employee working at a retail store selling consumer commodities at retail. Excludes non-retail roles in the same business (warehouse, distribution, corporate). Threshold counts retail employees across all NY locations of the same employer (not per-store).
When are the requirements effective?
Most requirements effective March 4, 2025 — six months after September 2024 signing. Specifically required by March 2025: written WV prevention policy; annual training program; employee notification. What's the panic button system?
Retailers with 500+ retail employees company-wide must implement a panic button (silent alert) system by January 2027. The system must: (1) let employees discreetly summon assistance during a workplace violence incident; (2) deliver alert with location to designated responders (security, management, or 911); (3) be accessible from employee work areas; (4) be tested periodically. Format flexible — physical button, mobile app, wearable device, or combination. The plan includes the framework.
What training is required?
Annual workplace violence prevention training covering five required topics: (1) WV definition and types (criminal intent, customer, worker-on-worker, personal relationship); (2) Identifying warning signs of violence; (3) De-escalation techniques; (4) Active shooter / emergency procedures; (5) Reporting and post-incident procedures. Training must be at hire and annually thereafter. The plan includes the training outline.
How does this relate to NY HERO Act?
NY HERO Act (Labor Law §218-b) covers airborne infectious disease — a separate mandate. Retail Worker Safety Act (§27-e) covers workplace violence — focused on customer/external violence in retail settings. Most NY retailers need BOTH plans — the HERO Act plan for infectious disease (passive — activated when commissioner designates), the Retail Worker Safety Act plan for workplace violence (actively required from March 2025).
